CMS Likely Not To Appeal Broughton Decision Morganton- The Center for Medicare and Medicaid Services has announced that they will likely not appeal a judge's decision on Broughton Hospital. The News Herald reports that the judge ruled on March 31 that funding to the hospital should have never been pulled. CMS decided to pull the funding after two patient deaths in August 2007. Funding began in July 2008 again after the hospital had changes in management, including their director. Mark Sciver, who is a spokesperson for the state, said that CMS has made it verbal that it will not contest the judge's ruling.
