Morganton- A Burke County man has been arrested and charged with shooting his stepson.

Police have charged Robert Smith, 55, with assault with a deadly weapon with intent to kill.

Police say that Smith shot his stepson, Kevin Brittain, 34, Wednesday evening at a home on Ridgecreek Drive.

Smith told police that Brittain was stealing items from his home.

Brittain was treated and released from the hospital after being struck by one pellet from the shotgun bullet.
